54. Where the proof heard out of court under article 196 of the Code of Civil Procedure (chapter C-25) has been filed in the record, the clerk must, if he does not have the authority to render a judgment and the court does not sit in the district, transmit the record to the judge who authorized the proof to be heard out of court.
